Attorney Statement

Shao Ming and Huang Zhibin, attorneys from AllBright Law Offices, entrusted by Shanghai Cathay R&D Center Co., Ltd. (“Shanghai Cathay”) and Shandong Cathay Biotechnology Co., Ltd. (“Shandong Cathay”), jointly issue the following statement:

I. Shanghai Cathay owns a series of patented processes producing long chain dicarboxylic acids (“Product(s)”) by bio-fermentation, including but not limited to an invention patent named as “a process for producing long chain dicarboxylic acids” (patent #: ZL 200410018255.7)(“Patent”), which has been exclusively licensed to Shandong Cathay. Therefore, it is Shanghai Cathay and Shandong Cathay having the intellectual property right of the Patent protected by the Chinese law.

II. With the Patent, Shandong Cathay is a leading supplier of the Product world-wide. Shanghai Cathay and Shandong Cathay hereby solemnly declare that no enterprise or individual may, without permission of Shanghai Cathay and Shandong Cathay, use the patented process to produce the Product, or use, offer to sell, sell or import the Product directly obtained by the patented process, for the purpose of business. In addition, no enterprise or individual may infringe the legitimate rights and interests of Shanghai Cathay and Shandong Cathay by illegal manners. Otherwise，these activities may constitute infringement and the infringer shall be held liable according to law.
